Repair and Return Policy

LAVRY ENGINEERING REPAIR AND RETURN POLICY

By shipping a unit to us, you agree to the terms and conditions of our repair and return policy. Every unit returned to Lavry Engineering must have a Return Materials Authorization (RMA) number that has been provided by us, or it will not be accepted.

For an RMA number and a “ship to” address please call Lavry Engineering at (360) 598-9757 or submit a support ticket. A separate RMA number must be obtained for each unit being returned. You must provide the unit name and serial number when requesting an RMA number.

Lavry Engineering reserves the right to determine whether a returned unit is covered by warranty or not. Sometimes this cannot be determined until the unit is returned to Lavry Engineering for examination. Lavry Engineering provides the following limited warranty with its products:

LIMITED WARRANTY

Subject to the conditions set forth below, for one year after the original purchase date of the unit (unless otherwise specified), Lavry Engineering will repair the unit free of charge in the United States in the event of a defect in materials or workmanship. This warranty is extended only to an original purchaser of the unit from Lavry Engineering, or an authorized reseller of Lavry Engineering. Units that are purchased from unauthorized resellers do not have any warranty coverage. A valid purchase receipt or other valid proof of purchase will be required before warranty service is provided. This warranty only covers failures due to defects in materials or workmanship and does not cover damages which occur in shipment or failures resulting from accident, misuse, line power surges, or mishandling, or from maintenance, alterations, or service of the unit by an unauthorized service center or individual. Lavry Engineering reserves the right to deny warranty service to units that have been used in rental, service bureau, or similar businesses. THIS LIMITED WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS. YOU MAY HAVE OTHERS WHICH VARY FROM STATE/JURISDICTION TO STATE/JURISDICTION.

REPAIRS MADE UNDER WARRANTY

If an entire unit is covered by warranty, Lavry Engineering will be responsible for all parts and labor necessary to fix defects in materials or workmanship. If only certain parts of a unit are still covered by warranty, Lavry Engineering will only be responsible for parts and labor necessary to fix defects in materials or workmanship for such parts.

NON-WARRANTY REPAIRS OR UPGRADES

If any unit that is returned to Lavry Engineering is not covered by warranty, or is returned for an upgrade, you must pay a non-refundable minimum charge of two hours labor at our then current hourly rates, plus all shipping costs. Once we receive a unit, we will contact you to give you an estimate of the total cost of the repair or upgrade. If you decide not to proceed with the repair or upgrade, you are still responsible for the two hour minimum charge and all shipping costs. You are responsible for all parts, labor and shipping costs necessary to complete a non-warranty repair or upgrade whether or not it exceeds our estimate.

REPLACED, REPAIRED OR UPGRADED PARTS

In performing services, Lavry Engineering may use new or rebuilt parts. All replaced, repaired or upgraded parts are warranted against defects in materials or workmanship for a period of one year from the date of servicing, whether such parts are new or rebuilt. This warranty only applies to the replaced, repaired or upgraded parts, and does not apply to the entire unit, or to any parts that were not replaced, repaired or upgraded.

SHIPPING

If a unit covered by warranty needs servicing during the first 30 days after the original purchase date, Lavry Engineering will cover the cost of shipping the unit back to Lavry Engineering as well as the return shipping to you. After such initial 30 day period, and for one year after the original purchase date, Lavry Engineering will only cover the cost of shipping the unit back to you, and you are responsible for the cost of shipping the unit to Lavry Engineering. You are responsible for all shipping costs both to and from Lavry Engineering for non-warranty repairs or upgrades. You are responsible for paying all taxes, import duties, or similar fees imposed by foreign countries or other jurisdictions.

LIMITS AND EXCLUSIONS

LAVRY ENGINEERING DOES NOT, BY VIRTUE OF THIS DOCUMENT, OR BY ANY COURSE OF PERFORMANCE, COURSE OF DEALING, OR USAGE OF TRADE, MAKE ANY OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, ANY WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE OR NONINFRINGEMENT, AND ALL SUCH WARRANTIES ARE HEREBY EXPRESSLY DISCLAIMED. LAVRY ENGINEERING EXPRESSLY DISCLAIMS ANY IMPLIED INDEMNITIES. LAVRY ENGINEERING SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, PUNITIVE, SPECIAL OR EXEMPLARY LOSSES OR DAMAGES, INCLUDING, WITHOUT LIMITATION, DAMAGES TO RECORDINGS, TAPES OR DISKS, DAMAGES FOR LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION, LOSS OF GOODWILL, COVER, OR OTHER PECUNIARY LOSS, ARISING OUT OF OR RELATING TO THE USE OF ANY PRODUCT, OR ARISING FROM BREACH OF WARRANTY OR CONTRACT, NEGLIGENCE, OR ANY OTHER LEGAL THEORY, EVEN IF LAVRY ENGINEERING HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH LOSSES OR DAMAGES. ANY DAMAGES THAT LAVRY ENGINEERING IS REQUIRED TO PAY FOR ANY PURPOSE WHATSOEVER SHALL NOT EXCEED THE ORIGINAL COST PAID TO LAVRY ENGINEERING FOR THE APPLICABLE UNIT. BECAUSE SOME STATES/JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, THE FOREGOING LIMITATION MAY NOT APPLY TO YOU.
